Lucky Draw Terms of Use

PLEASE READ THESE TERMS AND CONDITIONS (‘T&C’) WHICH GOVERN THE LUCKY DRAW (THE “DRAW”). YOU/AN ELIGIBLE PERSON HEREBY ACKNOWLEDGE, ACCEPT AND THEREBY AGREE ON IRREVOCABLE BASIS, TO BE LEGALLY BOUND BY ITS TERMS AND CONDITIONS MENTIONED HEREUNDER

• This Lucky Draw is organized by Valuesurge Private Limited having registered office at NO.60, SKYLINE ESTATE, 3RD CROSS, 1ST MAIN ROAD, HORAMAVU, BENGALURU – 560043 (“Valuesurge/Organiser”). In addition to these Terms and Conditions, You shall also be bound by the privacy policy and the terms and conditions as is provided under [https://rupeezen.com/privacy-policy] and [https://rupeezen.com/terms]
• The Eligible Persons agree to abide by these Terms & conditions in its entirety. The Organizer reserves the right to modify the Terms at any time, with notice on the website. You agree to review these T&C from time to time to be aware of the changes mentioned hereunder.
• The Organizer reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this Draw or any part thereof including the eligibility criteria at its sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on an Eligible Person.
• The annexure to these Terms and Conditions contains the eligibility criteria for participating in the draw. Please note that the Organiser reserves the right to change the eligibility criteria from time to time. Each Eligible Person agrees that the Draw does not constitute a lottery and there is no consideration charged to the Eligible Person for participating in the Draw. The Draw is an incentive to promote savings and motivate users of the Valuesurge application to save more.
• A Eligible Person, by participating in the Draw hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the criteria and process of selecting the winners as set out herein. It is also understood and agreed by the Eligible Person that mere participation or eligibility to this Draw does not entitle the Eligible Person /s to claim the Prize. He /she should be a selected/ declared Winner by Organizer in conformity with the T&C.
• By entering the Draw, an Eligible Person confirms and waives the applicability of rules and regulations of the National Do Not Call Registry and also agree to receive promotional messages from Organizer including communication about the Winners, as it may deem fit and proper, at their sole and absolute discretion. In the event that the Customer has opted out of receiving such communication, either with Valuesurge or with any statutory authority, it shall not receive any communication and Valuesurge disclaims any liability with respect to the same.
• Winners will be selected on random basis and will be announced on a [weekly] basis on the [website of Valuesurge]. This selection of the winners shall be final and binding upon all Eligible Persons. The Winners shall be intimated through Whatsapp or SMS by Organizer to the mobile number of the Winner that he/she has provided during the subscription to the Valuesurge App. Each Eligible Person hereby understands and agrees that the responsibility of Organizer is limited only to the extent of communicating it to them about winning the Draw and the Prize won by them
• The Prize for the purpose of the Draw shall mean a cash prize of INR 1000 credited to the saving account of the Winner. Valuesurge reserves the right to change the Prize at its sole discretion by putting up a notice on the website.
• Where prizes contain a specified validity period during which it should be utilized, no requests for extensions or replacements whatsoever will be entertained.
• Valuesurge has the right at any time to, and without notice, substitute any prize with another prize of similar value as determined by Valuesurge. Prizes won are given out on an ‘as its is’ basis, and are not transferable, exchangeable or redeemable for cash. All warranties and representations in connection with the prizes are expressly excluded to the extent not prohibited by law.
• Valuesurge’s decisions on all matters relating to this Lucky Draw are final, binding and conclusive on all Eligible Persons, and no correspondence will be entertained.
• The Eligible Person including the Winners understand and agree that Organizer shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to a Eligible Person and/or any third party, directly or indirectly, by use or non-use of the Gratification.
• By participating in this Lucky Draw, Eligible Person agree that Valuesurge and its affiliated companies and business units may collect, use and disclose their personal data for the following purposes: to provide them with products and services; consumer research, promotional and marketing purposes; for the management and administration of the Lucky Draw; to verify if Eligible Person qualify for the Lucky Draw; and to provide Eligible Person with benefits of the Lucky Draw. Valuesurge and its affiliated companies and business units may share Eligible Person’ personal data between themselves for administrative purposes, and with third parties supporting their administrative and business functions.
• If a Eligible Person wishes to withdraw consent to any specific use of his or her personal data, the Eligible Person may do so by sending an email to help@rupeezen.com. Please note that if you exercise this option, Valuesurge reserves the right to consider you as not eligible to participate in the Draw with no liability. In addition, if you exercise this option Valuesurge also reserves the right to and might choose to terminate its services to the user or provide services in a limited manner.
• Valuesurge has the right to disregard or disqualify any entry, Participator winner, in such manner as Valuesurge deems fit, without giving notice or reason, and without any liability to any person. In particular, no Eligible Person shall, or procure another person to, (i) tamper with the operation of the Lucky Draw or the relevant website, (ii) participate in the Lucky Draw in any manner which may create any prejudice to or anomaly in the scoring system or operation of the Lucky Draw, and/or (iii) breach these Terms and Conditions or any other applicable law or regulation.
• Each Eligible Person also agrees that all worldwide intellectual property rights in any statement, materials or content submitted, made or created by a Eligible Person in connection with this Lucky Draw and any derivative works arising therefrom will be perpetually and unconditionally vested in, assigned to, and owned by, Valuesurge. Valuesurge has the right to use and modify such statement/materials/content/works in any way it deems fit without compensation to any Eligible Person, and each Eligible Person waives all rights (including moral rights) he/she may have in such statement/materials/content/works.
• Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in connection with this Lucky Draw, in particular that relating to the Lucky Draw prizes, are the property of their respective owners.
• This Draw is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Organizer. In case of force majeure conditions, no liability in whatsoever manner shall fall upon Organizer.
• Income tax, gift tax or any other statutory taxes, duties or levies as may be applicable from time to time, arising out of free Prize, which shall be solely borne by the winners for all the Prizes.
• All matters in connection with this Lucky Draw are governed by Indian law and Eligible Person agree to submit to the exclusive jurisdiction of the Bangalore courts.
• In case of any queries/ complaints, the Eligible Person shall have to directly contact Organizer at (address): NO.60, SKYLINE ESTATE, 3RD CROSS, 1ST MAIN ROAD, HORAMAVU, BENGALURU – 560043 regarding any queries /complaints. Annexure I

Eligibility Rules

• Complete at least 1 streak of 5 timely payments between Sunday and the following Saturday to qualify for that week’s lucky draw
• Minimum saving amount is Rs.300 across the 5 timely payments to qualify for the draw.
• Minimum goal saving balance of Rs. 500 to qualify for the draw.
• Goal saving balance for criteria #3 above will be as on Saturday, 2:30PM.
• New sign ups during the week of the lucky draw will be excluded from that particular week’s lucky draw and will be eligible for the subsequent draws subject to fulfilling criteria above.
